Terms and Conditions
These terms and conditions govern the Instrumental Find Future Superstars Competition. References to “us”, “we”, “ours” and “Instrumental” shall be to the Promoter (as detailed in condition 1 (The Promoter) below). References to “you” or “yours” shall be to you, the person who has entered, or is considering entering into, the Instrumental Find Future Superstars Competition. Entry into the competition in accordance with condition 3 (How to Enter) below shall be legally binding on you and us.
The promoter is: BC Music Media Limited trading as Instrumental, a limited liability company with company number 08275462, whose registered office address is at 1 Hammersmith Broadway, London, W6 9DL and whose principal place of business is at Unit 8G Leather Market, 11 – 13 Weston Street, London, SE1 3ER.
2.1 The title of the competition is “Instrumental Competition: Find Future Superstars” and is directed towards those who are on the hunt for talented up-and-coming musicians (also known as “music scouts”).
2.2 All you have to do to enter the competition is answer the following question: AS A MUSIC SCOUT, WHAT IS YOUR BIGGEST SCOUTING CHALLENGES?
2.3 All entrants are required to provide an answer to the question in condition 2.2 above in accordance with the process outlined in condition 3 (How to Enter) below.
2.4 Those who (i) answer the question in condition 2.2 above, (ii) are eligible (see condition 4 below) and (iii) follow the process in condition 3 below, will be entered into the competition which will run for three weeks from 1200hrs (noon) BST on 29 October 2018 (the “Opening Date”) to 1200hrs (noon) GMT on 19 November 2018 (the “Closing Date”) inclusive. A winner will be selected at random to receive a free trial of the Instrumental music scouting platform.
3.1 To enter the competition, you must send a completed entry form, which can be found on Google Forms by the Closing Date. Please note that anything you submit via the Google Form may be shared and promoted across Instrumental’s social media platforms without your consent.
3.2 All competition entries must be received by the Promoter by no later than 1200hrs GMT (noon) on the Closing Date. All competition entries received after the Closing Date shall be automatically disqualified.
3.3 There is no requirement to make any purchase in order to enter into the competition, nor is there any charge to register for use of the Instrumental website.
3.4 The Promoter will not and shall not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
3.6 The competition winner will be decided by a random name generator. The decision will be final.
3.7 The Promoter will send a summary of the selection process to anyone who (i) writes to the Promoter at Unit 8G Leather Market, 11 – 13 Weston Street, London, SE1 3ER within one (1) month after the Closing Date of the competition requesting further details of the selection process and (ii) encloses a self-addressed envelope. The summary shall include the name and country of the winner. Note that if you are selected as the winner, your name and country of residence will be shared in this way.
4.1 To be eligible, you must be aged 18 years or over and you must be a music scout for commercial purposes.
4.2 You are not eligible if you are an employee of the Promoter or its holding or subsidiary companies.
4.3 In entering the competition, you confirm that you are eligible to do so and that you are eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
4.4 The Promoter shall not accept competition entries that are:
4.4.1 automatically generated by a computer or other automated device; and/or
4.4.2 completed by third parties on behalf of the entrant or in bulk; and/or
4.4.3 illegible, have been altered, reconstructed, forged or tampered with; and/or
4.5 There is a limit of one entry per person.
4.6 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
5.1 The prize is a one-month free subscription to Instrumental’s music scouting platform.
5.2 The winner will be notified by phone or email and will be required to take part in an online training session before receiving their free trial.
6.1 The winner of the competition shall be announced on Instrumental’s website and/or social media platforms on or around 19 November 2018 (the “Announcement Date”).
6.2 The Promoter shall contact the winner as soon as practicable after the Announcement Date via the telephone number and/or email address provided with their competition entry.
7.1 In order to claim the prize, the winner must respond to the phone call and/or email within fourteen (14) days of receiving such phone call and/or email. Failure to adhere to this condition 7.1 will result in you losing your right to the prize.
7.2 The prize may not be claimed by a third party on the winner’s behalf.
7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted, is unavailable or has failed to claim the prize in accordance with condition 7.1 above, the Promoter reserves the right to offer the prize to another eligible entrant selected from the entries that were received before the Closing Date.
7.4 The Promoter does not accept any responsibility if the winner is unable to take up the prize.
7.5 The Promoter does not offer any cash prize alternatives should the winner be unable to take up the prize.
Insofar as is permitted by law, the Promoter, its agents and/or distributors shall not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents and/or distributors or that of their employees. Your statutory rights are not affected.
9.1 All competition entries and any accompanying material submitted to the Promoter shall become the property of the Promoter on receipt and shall not be returned.
9.2 By submitting your competition entry and any accompanying material, you agree to:
9.2.1 assign to the Promoter all your intellectual property rights with full title guarantee; and
9.2.2 waive all moral rights in and to,
your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
9.3 You agree that the Promoter may, but is not required to, make your entry available on its website (weareinstrumental.com) and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
10.2 By entering this competition, you are giving the Promoter consent to contact you whether you are a prize winner or not.
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
